LANSING, MI (WKZO AM/FM) – Michigan Attorney General Dana Nessel is joining a coalition of attorneys general urging a federal appeals court to uphold an order from a lower court requiring U.S. Immigration and Customs Enforcement agents to adhere to statutory safeguards when making warrantless arrests.
The coalition argues the preliminary injunction against ICE serves the public interest.
Federal law allows a warrantless arrest by federal immigration officers only when there is probable cause to believe the person is in the country illegally and is likely to escape before a warrant can be obtained.
