KALAMAZOO (WKZO AM/FM) — The lawyer for suspected mass murderer Jason Dalton will square off Tuesday with an Assistant Prosecutor from Kalamazoo County over whether the statements made by Dalton to detectives after his arrest should be admissible at trial.
The State Court of Appeals in Lansing will hear their arguments despite initially rejecting Dalton’s appeal last fall.
The State Supreme Court has ruled that they should hear the claims made by the defense that despite repeated requests by Dalton for a lawyer during interrogation, detectives continued to question him without one.
It was during those interviews that Dalton allegedly made the claim that the Uber cell phone program notified him to kill the people interested in catching a ride that night.
It’s been nearly two and a half years since police say Dalton went on a shooting spree shooting 8 people at random and killing six of them.
Prosecutor Jeff Getting says he has enough eyewitnesses, forensic and other evidence to convict Dalton of the crimes without the confessions, but his guilt or innocence may not be the issue at trial if Dalton attempts an insanity defense, as his lawyers have proposed.
