BATTLE CREEK, MI (WNWN) – A Battle Creek man who once was charged with a 2019 murder entered a guilty plea on Wednesday in Calhoun County Circuit Court to a count of assault with a dangerous weapon.
24-year-old Xavier Kellie-Sims has been in jail for almost two years.
The homicide charges were dismissed after testimony during a preliminary hearing indicated bullets from a gun used by Kellie-Sims did not kill 23-year-old Elijah Williams.
Williams was shot during an exchange of gunfire at a October 2019 party on West Northside Drive.
Kellie-Sims was facing a charge of assault with intent to murder but the charge he entered his guilty plea to on Wednesday was in connection with a separate incident in August of 2019.
The Battle Creek Enquirer reports Kellie-Sims was released from jail on Wednesday after charges of assault to murder from the October 2019 shooting were dismissed due to witnesses and victims being uncooperative with authorities.
The plea agreement calls for Kellie-Sims not to serve any more jail time when he is sentenced on December 17.
