BATTLE CREEK, MI (WKZO AM/FM) – The City of Battle Creek has won a legal battle concerning a six-story, 120-year-old downtown building.
The Battle Creek Enquirer reports Calhoun County Circuit Court Judge Sarah Lincoln granted a motion by the city on Thursday to have part of the Binder Building removed because its unsafe.
While the tower will be demolished while two other sections will stay.
The City of Battle Creek and the city’s Historic District Commission got into a dispute over the tower section early this year.
The city claimed the tower section was a public hazard but it’s location in the historic district was delaying further action.
Several floors inside of the tower collapsed in September of 2019. The H.D.C. denied the city’s request for demolition during a meeting last January 13th as some members did not believe the conditions to proceed with demolition were met.
