GRAND RAPIDS, MI (WKZO AM/FM) – U.S. District Judge Jane Beckering has dismissed the lawsuit filed by the U.S. Department of Justice challenging Michigan’s ban on selling eggs from hens living in cages.
Beckering says the federal government lacks the standing to sue the state, but did not rule on if the state’s cage-free egg law violates the federal Egg Products Inspection Act.
She wrote “Michigan cannot violate EPIA merely by enacting legislation because EPIA does not regulate how states may legislate.”
Beckering says the EPIA was enacted to protect the public from unwholesome or mislabeled eggs and the DOJ wanted to strike down the state’s Animal Husbandry Industry Act, which she says was designed to protect people’s health and safety.
