WASHINGTON, DC (WKZO AM/FM) – The lawsuit filed by Enbridge over their efforts to build a tunnel under the Straits of Mackinac will continue after the U.S. Supreme Court declined to take up Governor Whitmer’s argument that the state has immunity.
Whitmer says that is based on the 11th Amendment to the U.S. constitution, saying states cannot be sued in federal court without their consent.
Lower courts have ruled the state does not have that immunity in this case.
Whitmer has been trying to get Enbridge’s Line 5 pipeline currently on the lakebed in the Straits of Mackinac shut down since she took office.
