LANSING, MI (WKZO AM/FM) – Michigan Court of Claims Judge Sima Patel has denied the state’s request to block a lawsuit from the Michigan Cannabis Industry Association challenging the 24% wholesale tax on marijuana sales.
That means the lawsuit will proceed.
The MCIA says the wholesale tax is not legal and violates the intent of the cannabis legalization approved by voters in the state in 2018.
The tax took effect January 1st and was part of the Fiscal Year 2026 state budget.
