MATTAWAN (WKZO AM/FM) — A former Mattawan Police Officer, who is facing a charge of reckless use of a firearm, is getting a couple of motions approved by the judge before going to trial.
The incident occurred last November when Chelsey Omilian opened fire at a car that had been reported stolen by Gary Kingsbury that later crashed on Giddings Court off of McGillen Avenue.
Investigators say she had only been on the job for two months when she fired five times, wounding a woman in the back seat who was never charged.
Omilian originally claimed she felt threatened by the driver, who she knew to be a felon and thought was armed.
Her defense motions, which were granted, are that the judge notify the jury that its legal for an officer to shoot a fleeing felon, and that she was aware of his criminal history.
