NEW YORK (Reuters) – American Eagle Outfitters sued Amazon.com on Wednesday, accusing it of infringing the clothing and accessories retailer’s “Aerie” and “Offline by Aerie” trademarks in sponsored advertisements and search responses.
In a complaint filed in Manhattan federal court, American Eagle said Amazon intentionally used the Aerie marks without permission “to deceive consumers into believing Aerie products were available on Amazon, drive traffic to its platform, and sell competing merchandise.”
The lawsuit seeks a halt to further infringements, triple and punitive damages, and other remedies.
