KALAMAZOO (WKZO AM/FM) — Discover Kalamazoo suffered a defeat in court this week when Federal Judge Paul Maloney dismissed their request for a preliminary injunction that would have blocked Southwest Michigan First from calling their magazine “269”.
Apparently the Judge wasn’t convinced that Discover Kalamazoo will suffer any immediate harm if South West Michigan First continues to use the number for now.
In the suit Discover Kalamazoo claims they have used the local area Code for several of its promotions for years and Southwest Michigan First is violating its trademark.
A hearing is set for August 9th to determine if-and-when the suit will go forward but no trial date is set. They aren’t giving interviews because the case is pending and they say they want to keep it out of the media.
