KALAMAZOO, MI (WKZO AM/FM) — The year is ending with Graphic Packaging and a lawyer representing neighborhood residents exchanging shots in their ongoing lawsuit over emissions from the plant.
Lawyer Tyler Dancer filed a response to the company’s request that an earlier filing be denied by repeating claims that the company is releasing toxic pollutants into the neighborhood, like hydrogen sulfide, causing health problems. He says in a 22-page filing the tests done to date are insufficient and more should be conducted on other chemical substances, as state agencies have recommended.
In response the company issued a statement saying they don’t comment on pending litigation, but do defend themselves against false and misleading claims, saying that since 2021, they have reduced hydrogen sulfide concentrations by 81%, and continue to work on others.
The plaintiffs are asking a federal judge to give their lawsuit class action status.
