KALAMAZOO (WKZO AM/FM) — There appears there will be another delay in the trial of suspected mass murderer Jason Defense Attorney Eusebio Solis will appeal a ruling over the admissibility of statements made by Dalton after his arrest to the State Supreme Court.
The Court of Appeals declined to even hear the motion. At issue is whether Dalton should have been questioned after he asked for an attorney. Circuit Judge Alexander LIpsey has ruled that some of it is inadmissible, but some of it can be used at trial.
The Defense would like the Justices to toss all of it out.
Prosecutor Jeff Getting is requesting that the High Court let Judge Lipsey’s ruling stand.
However they rule, it will likely delay the trial until early next year.
