ALLEGAN (WKZO) — A former inmate at the Allegan County jail who has filed a lawsuit claiming he was assaulted may have a strong case.
It’s been revealed that a special investigation conducted by Berrien County’s Sheriff recommended that the correctional officer involved be charged with aggravated assault.
Allegan County’s Prosecutor declined to file those charges, claiming he couldn’t prove the officer “intended” to hurt inmate Aaron Henderson, when he allegedly kneed him twice in the face.
The officer, Jacob Kapanui was suspended for a day without pay for using improper technique during the attempt to put the inmate in a suicide gown.
The 45-year-old Henderson was left in his cell bleeding with several broken facial bones for 12-hours before the next shift discovered what had happened and took him to the hospital for treatment.
His suit is seeking damages.
