LANSING (WKZO-AM) — The Michigan Court of Appeals will be asked to decide if a confession letter written by an accused killer of an infant can be used against him in a murder trial.
Mason County judges are split on whether the letter penned by Sean Phillips equates to a confession that he killed four-month-old Baby Kate. The letter was addressed to the child’s mother.
In the letter, Phillips claims the child’s death was accidental.
The defense claims the letter fails to show intent. The prosecutor says it’s an admission of guilt.
Kate disappeared in 2011. She has never been found.
