MATTAWAN, MI (WKZO AM/FM) – Mattawan Consolidated Schools is the latest district to be sued over the mandate of masks in the classroom.
A group of five parents filed the lawsuit last week in Van Buren County Circuit Court against the school district, Superintendent Randy Fleenor, and members of the Mattawan Board of Education, saying the district does not have the authority to mandate a “medical device.”
The lawsuit also contends the superintendent does not have the authority to mandate the children wear masks at school because he is not an elected official.
A Kalamazoo County Circuit Court judge earlier this month denied a preliminary injunction in the lawsuit challenging the Portage Public School district’s mask mandate.
Judge Alexander Lipsey ruled the district’s mask policy falls under “The general rules of preservation of safety and health.”
The lawsuit was by a group of seven parents who argued the school district was breaking state health laws by mandating masks or face coverings for K-12 students. Portage Public Schools issued its own mask mandate following the December 17, 2021 expiration of the Kalamazoo County Department of Health and Human Services mask mandate.
