CALHOUN COUNTY (WKZO-AM) — A Springfield man who was wounded by a Calhoun County Sheriff’s deputy when he flashed a toy gun last month has recovered sufficiently to be charged with five felonies.
Derrick Shirk, 50, was driving a pickup that matched the vehicle seen in security videos during a robbery at a Battle Creek gas station. Shirk was chased to a home where he produced the toy gun. It was all captured on a dash cam video.
The sergeant responded with warnings. When Shirk didn’t comply, he shot the suspect with two rounds in the torso.
Shirk was charged on Wednesday with two felonies for the gas station hold up, and three counts for the high-speed chase and shoot-out.
Shirk has a long criminal history and was a parole absconder at the time of the shooting. A conviction on any of the counts will likely result in a life prison term.
