KALAMAZOO (WKZO-AM) — A cab driver convicted on kidnap and rape charges has been ordered back to Kalamazoo for resentencing.
Robert Prescott was already a felon on parole when he got a second chance, driving for Godspeed Taxi.
In 2014, he drove a female customer to a secluded parking lot and raped her at gunpoint. He was convicted on 15 felony counts and given 42 to 60 years in prison, following the sentencing guidelines at the time.
Prescott’s appeal was recently dismissed by the Michigan Court of Appeals. But the three-judge panel did order that he be resentenced because the guidelines used then have been ruled unconstitutional.
It’s not necessarily a victory for Prescott. The judge could review his record and the case against him and give him more time. He could also get less.
Whatever happens, Prescott, who is 40, will likely be a senior before he becomes eligible for parole.
