LANSING, MI (WHTC-AM/FM) – A showdown between Michigan’s legislative and executive branches of government may be decided by the judicial branch today.
The Court of Claims has a 10 AM hearing on arguments in the case of MI House/MI Senate v Governor. The two legislative chambers filed the lawsuit claiming that Governor Whitmer violated the constitution by invoking a new state of emergency without legislative approval when an earlier declaration expired April 30.
The plaintiffs want her new declaration declared null and void immediately. The Governor claims that a 1945 law enables her to act in this matter without legislative consent.
State House Representative Mary Whiteford of the South Haven area says that the litigation is aimed at resolving this issue for the long term. “We have to get this clarified for future generations,” the second-term Republican said on “WHTC Talk of the Town” earlier this week, “Can a governor do this forever? What is the role of the Legislature in a Constitutional role?”
