BATTLE CREEK (WKZO AM/FM) — The Battle Creek City Commission has voted unanimously to consider an ordinance that would give city officers authority to ticket drivers who use handheld cell phones while they are driving.
Last night they voted to amend it to exclude Sky-warn and other short wave operators who may be using their gear during weather events.
That’s a pretty clear indication that it will probably pass when it comes up for final adoption at their first meeting in February.
The proposal actually came from their Bicycle Task Force, because they worry about getting hit by a distracted driver.
One commissioner suggested that once they pass it, they should contact state lawmakers and encourage them to takke similar action in Lansing.
Sponsor Kaytee Faris says the state law limits the offense to texting while driving. Her ordinance proposal would include anything you do with a phone if it’s hand held.
Chief Jim Blocker says they don’t plan to make it a department focus, but if an officer sees a driver using a cell phone, it or it becomes a factor in a crash, they can cite the driver.
Other Commissioners say if nothing else it could save lives by simply being a deterrent.
