LANSING (WKZO AM/FM) — Attorney General Dana Nessel has issued an opinion saying that the Line 5 tunnel legislation approved during Lame Duck Session is unconstitutional.
Late Thursday, Governor Gretchen Whitmer issued an order directing state departments to halt any actions related to the law.
Nessel says the bill tries to do too many things that are not disclosed by its title, and therefore violates the State Constitution’s “title-object” clause.
She says that if the courts agree, it would probably void any action taken by the Corridor Authority since it was appointed.
It is Nessel’s first opinion and not legally binding.
Enbridge has issued a statement saying they are “surprised and disappointed” by the opinion and will seek clarification from the Whitmer Administration on the way forward, but court action seems likely.
