BATTLE CREEK, MI (WKZO AM/FM) — A Calhoun County woman free from prison after serving 18 years for the death of her 11-month-old daughter will not be returning to court. Tonia Miller had her conviction reversed and prosecutors have decided not to retry her on Second Degree murder charges.
She was found guilty in a shaken baby syndrome case in 2002, but her lawyer says advanced science determined the baby actually died from pneumonia. Miller is now 38-years-old. She won the battle on Monday thanks to work by the Michigan Innocence Clinic and her trial attorney.
She was released from prison back in April.
