SANILAC COUNTY (WKZO AM/FM) — It’s a case that has outraged the state and is going national but the explanation for a Sanilac County judge’s decision to award custody to the rapist who fathered the child of a 12-year-old rape victim has become a little clearer, but aggravating in a different way. .
27-year-old Christopher Mirasolo is a convicted child molester who has been convicted twice of sexual assaults on underaged girls. He is currently on parole for the second assault and not exactly father material.
That’s why the victim’s attorney called the judge’s order that he get joint custody “Insane”. She says the court gave MiraSolo the victim’s address and ordered that his name be put on the child’s birth certificate, without the mother’s consent. They didn’t even bother to ask her.
The victim told CBS’s Morning show that the whole experience has given her flashbacks to the two days she was kidnapped and held prisoner by Mirasolo, who sexually assaulted her and threatened to kill her.
It was all because she is now getting social assistance and that agency insisted she identify the father of her child to be eligible.
That triggered a series of bureaucratic steps that went through the prosecutor’s office to determine if he was paying child support, and if not why not. It was then sent to a judge’s desk without anyone ever doing a background check on the natural but unsuitable Mirasoto.
As a stipulation of his parole, Mirasolo isn’t allowed to have contact with a child under 17 unless he is supervised by another adult.
But the actions taken by the court are all apparently part of a very standard paternity process.
The attorney for Mirasolo says this isn’t anything they requested either, and not one they initiated.
The explosion of negative media has prompted the judge to put a hold on his order and the Sanilac County Prosecutor has ordered that their processes be reevaluated.
The Attorneys for the victim and Mirasota now say they are working on a private settlement.
