LANSING (WKZO AM/FM) — An Indiana man sentenced in Berrien County for an armed robbery during which he held a gun to the clerk’s head and pulled the trigger, could get a few years shaved off his sentence on a technicality.
The State Supreme Court has ruled that the Judge who handed down Anthony White’s sentence of 9 to 40 years, erred when he assumed that the gun threat traumatized the victim.
The Judge gave White extra points assuming it would have traumatized most people, and that resulted in a longer sentence.
The justices say the assumption was not enough. ‘
It needed to be demonstrated that there was actual psychological harm done.
White’s next parole date isn’t until 2022.
