LANSING (WKZO-AM) — The Michigan Court of Appeals has ruled that a medical marijuana patient smoking inside of their own parked car in a public space is not shielded from criminal prosecution under the law that voters enacted seven years ago.
Robert Carlton was arrested at the parking lot of the Soaring Eagle Casino and lower courts had cleared him of any charges.
In overturning those rulings, the appellate justices also asked the district court to reconsider a separate decision denying the Isabella County Prosecutor’s Office from tacking on additional marijuana possession courts against Carlton.
