KALAMAZOO, MI (WKZO AM/FM) — A man convicted of killing a 13-year-old boy 6 years ago was resentenced on Thursday, November 9 to 40 to 60 years, with time served.
Victor Garay, who was 15-years-old at the time, shot and killed Michael Day in Kalamazoo’s Edison Neighborhood back in 2014. Authorities say the two were members of rival gangs.
Garay, who is now 24, was convicted of first-degree murder, conspiracy to commit murder, and two counts of possession of a firearm. He was first sentenced to life in prison in 2015 and admitted to firing two shots from a handgun, with one of the slugs found on Day’s body, according to investigators.
The Michigan Court of Appeals reversed Garay’s original sentence in 2017, and ordered him to be resentenced since his juvenile status wasn’t taken into account.
As a part of Thursday’s ruling, Garay will now have to serve a minimum of 42 years before he is up for parole.
