PORT HURON, MI (WTVB) – A federal judge in Port Huron is ruling that part of the Michigan Sex Offender Registry Act is unconstitutional.
U.S. District Judge Robert Cleland says a 2011 amendment that applied to minors and divided sex offenders into three tiers is unconstitutional because it is being enforced upon offenders who were in the system before it was enacted.
Friday’s ruling comes after the Sixth Circuit Court of Appeals ruled authorities could not enforce the law retroactively.
State legislators now have 60 days to create a new law.
