BATTLE CREEK, MI (WKZO AM/FM) — Two fire battalion chiefs in southwestern Michigan who wanted overtime for being on call have lost their case at a federal appeals court.
Howard Holt and Martin Erskine say they avoided alcohol, gave up sports and more to be on call for duty in Battle Creek.
Judge Janet Neff said they were exempt from overtime under the executive exemption in federal wage law stating their primary duty was determined to be managing employees at the department.
