CINCINNATI, OHIO (WKZO AM/FM) — Chalk up a win for motorists in Michigan who challenged the right of meter maids to go around chalking the tires of cars.
It’s done so that drivers who park in unmetered areas with time restrictions will be recognized the next time the Parking enforcers make their rounds.
Alison Taylor of Saginaw had exceeded the two hour limit in Saginaw Dozens of times and had received many $15 tickets.
Her lawyer argued that marking her car was a violation of her fourth amendment right against unlawful searches and seizures and a three judge federal panel at the Sixth Circuit Court of Appeals in Cincinnati agreed it constituted a trespass and was unconstitutional.
Cities will just have to figure out some other way to keep drivers from overstaying their welcome.
Because it was a federal suit, the ban on chalk now applies to cities in Michigan, Ohio, Kentucky and Tennessee.
