KALAMAZOO (WKZO AM/FM) — The way has been cleared for the trial of alleged Uber killer Jason Dalton.
Kalamazoo County Prosecutor Jeff Getting says he will not appeal a ruling that the interviews done by Kalamazoo and State Police Detectives violated Dalton’s Miranda rights and will not be allowed to be presented as evidence.
Getting says he has enough eye-witness and forensic evidence to get a conviction. He announced the decision at a closed status hearing on the case Friday morning.
Getting says he disagrees with the ruling by the Michigan Court of Appeals, tossing out the interrogation tapes, but after reviewing the appellate decision, which listed multiple reasons why the tapes should be tossed, and consulting with the victims, their survivors and law enforcement, decided it was time to go to trial.
Judge Alexander Lipsey has decided to ring in the New Year with the case, scheduling jury selection to begin January 3rd 2019 and for the trial to begin on the 7th at the Circuit Courthouse downtown.
They anticipate the trial will take about two weeks.
