The Michigan Supreme Court has rejected the appeal of Charles Pickett Jr., the man charged with causing Kalamazoo’s Biking Tragedy, clearing the way for his case to go to trial.
Pickett was allegedly intoxicated on pain pills and muscle relaxants when his pick-up truck crashed into nine members of the Chain Gang Bike Club on North Westnedge a year and a half ago.
Pickett’s Attorney, Alan Koenig challenged the decisions made by the Prosecutor and a local Judge to charge Pickett with five counts of 2nd degree murder. He argued that the facts in the case called for his client to be charged with reckless driving causing death.
Judges at both the Appellate and the Supreme Court ruled that the arguments weren’t worth hearing.
A status hearing to talk about a trial date will be held next Thursday.
