ALLEGAN COUNTY (WKZO AM/FM) — It took the Gun Lake Tribe nearly a decade of legal wrangling to get their Casino opened along U.S.131 in Allegan County against forces that hoped to stop them, and they are still in litigation with a property owner who claims the Casino has caused traffic issues and changed the character of his rural area.
Tuesday the U.S. Supreme Court for the second time heard arguments whether the lawsuit by David Patchak, who lives about three miles from the Casino should be allowed to proceed despite the fact that Congress approved a bill shutting down his suit.
The Justices had very tough questions for Patchak’s lawyer and didn’t seem to be buying his arguments, saying Congress has the authority to impact pending litigation.
If the high court rules in his favor, it’s still a long shot he will beat the casino, given the fact that the facility has been a major contributor to the local economy and institutions for years now.
It typically takes the high court several months to issue their ruling.
