LANSING (WKZO-AM/FM) — The Michigan Appellate Court is tossing out a big marijuana bust on a technicality.
Michigan State Police seized 15 pounds of marijuana from the trunk of Kevin Kavanaugh’s vehicle during a traffic stop along I-196 in Berrien County in 2014, but it came after the trooper had told the Florida man that he was going to give him a warning on the traffic violation. The court ruled Kavanaugh should have been allowed to leave then.
The judges ruled 3-0 that the trooper violated his rights by holding him there until a K-9 sniffing dog could be dispatched.
They reversed his conviction.
It may clear his record but won’t reduce his jail stay and he won’t be getting his dope back. Kavanaugh was freed in May after serving his time.
