LANSING(WKZO AM/FM) — A Kalamazoo man who is serving life for killing his 2-year-old son could get a new trial. The Michigan Court of Appeals has ruled that the attorney representing Brian Roberts failed to do his job.
You may remember the case of little Nemo Dodd.
Roberts changed his story several times to explain the 2014 death of the young boy, claiming initially the boy fell down the stairs and then admitting it was the result of potty training frustration.
The Appellate judges ruled that the attorney failed to challenge controversial evidence that head trauma that appears to be caused by abuse can be caused by other events.
The Defense Attorney, Eusebio Solis is the same lawyer now handling the defense of accused mass murderer Jason Dalton.
