LANSING (WKZO-AM) — Even though they have never found the body of his infant daughter, the Michigan Supreme Court has ruled that Mason County can try Sean Phillips for her murder.
Katherine Phillips disappeared in 2011 with her father behind the wheel. She was never seen again.
Phillips later claimed in a letter written to Baby Kate’s mother that the infant’s death was accidental, and that he buried her in a remote location. Phillips’ attorney appealed the murder charges, saying they could not prove the baby was dead.
They appealed at the circuit court level, then the appellate court and finally the Supreme Court. They were defeated at each level.
It clears the way for the Mason County Circuit Court to schedule a murder trial.
Phillips is currently serving a 10-year sentence for the unlawful imprisonment of the infant.
