LANSING (WKZO-AM) The Michigan State Senate has approved two bills that would decriminalize a person’s first arrest for being a minor in possession of alcohol, making it a civil infraction instead of a misdemeanor.
The legislation is sponsored by Rick Jones, R-Grand Ledge, who says the state is criminalizing young people who sneak a beer.
Penalties for repeat offenses would still be a misdemeanor.
A second offense could mean 20 days in jail and a $200 fine. A third arrest would expose the young drinker to up to 60 days in jail and a $500 fine.
Sen. Tonya Schuitmaker, R-Lawton, was one of only two Senators who voted against the legislation. She said it will just encourage teen drinking.
The two bills now go to the House for their consideration.
