KALAMAZOO (WKZO) — It was a case at the time that shocked the community, not because of its brutality, but rather the casual disregard and insensitivity.
Jheryl Wright was shot outside the Quick Stop on Portage Road in 2012 and fell in the doorway.
Store security video shows customers stepping over his body to get to their snacks and smokes, with no one trying to get help for him for at least five minutes.
Now the suspect convicted in that killing could get a new trial. 34-year-old Clarence Ross Jr. claims his attorney failed to call a witness who at the time, gave a description of a shooter who was tall and skinny, who did not resemble Ross, who is short and stocky.
The Michigan Court of appeals has scheduled a hearing to determine if there is any merit to Ross’s claim that his Lawyer was ineffective.
They will receive his motion for a new trial but decide whether or not to grant it later.
Prosecutors alleged that Ross was out to get revenge on Wright because he used counterfeit money to buy drugs.
