MASON COUNTY (WKZO) — The Attorney General’s office and the Mason County Prosecutor wants a new judge to preside over the Sean Phillips murder trial.
They have filed a motion asking Judge Peter Wadel to disqualify himself from the case.
Judge Wadel initially dismissed the charges against Phillips for lack of evidence and the A.G. had to appeal to get the charges reinstated.
Now he has assigned himself to preside over the murder trial.
They say there is no way given his history with the case, that Judge Wadel could remain impartial during the trial.
Bill Schuette says if the judge does not bow out of the case, they will petition the State Court Administrator to reassign the trial.
Phillips is suspected of killing and hiding the body of his infant daughter, Baby Kate, but that body has never been found.
