WASHINGTON (WHTC) – A federal court has dismissed for the second time a lawsuit filed by former Wayland Township Trustee David Patchak that sought to close the Gun Lake Casino. Patchak argued that the Gun Lake Tribe wasn’t organized when the federal law allowing land to be put in trust for Indian groups was enacted in 1934. The litigation was initially thrown out due to Patchak not having standing to sue, but the US Supreme Court overturned that. A new law passed last year stymied Patchak this time. No immediate word on whether Patchak will appeal again.
