WASHINGTON D.C. (WKZO) — Most experts believe the Supreme Court Justices have already made up their mind on the same sex marriage issue, regardless of today’s oral arguments and whether or not Michigan’s ban should be upheld.
WMU Cooley Law Professor Devin Schindler says take away all the legal arguments and the precedents and the fine points of the law, and the fate of Same Sex marriage comes down to the opinions of just one or two Supreme Court Justices who could swing the tide either way.
He says Justice Kennedy is the usual swing vote, but Schindler says Chief Justice Roberts, who is concerned about the court’s place in history and in the headlines could also swing it to one side or the other.
We really won’t know until they issue the ruling this coming summer.
While they haven’t gotten as much publicity, there are those who strongly believe that the institution and the sanctity of marriage, and perhaps all of society will crumble if gays are allowed to marry.
Tony Perkins, President of the Family Research Council says it can’t be allowed.
He says even if the Justices rule in favor of same-sex marriage, they will continue to oppose it, much as groups have continued to battle abortion despite the Supreme Courts Rowe Vs Wade ruling decades ago.
