U.S. Supreme Court weighing Michigan's Affirmative Action Ban

by

WASHINGTON D.C. (WKZO) -- It may take until next summer for Supreme Court Justices to issue a ruling on whether Michigan’s voter approved ban on affirmative action in college admissions is constitutional.

They heard the arguments yesterday and it’s difficult to judge how they may split.

Attorney General Bill Schuette wonders how there can be discrimination if race is taken out of the equation, as the state law does?

But ACLU Attorney Mark Rosenburg says the whole idea is to right past wrongs by considering race as a positive factor.

With one Justice recusing herself for previous involvement in the case, its hard to tell what the Justices may do, when they eventually issue an opinion sometime next year.
