Victor Sneed filed suit against Brand in October (12), alleging the Forgetting Sarah Marshall star knocked him down with his Range Rover last January (12).

Brand has now fired back at the allegations, arguing that if a run-in occurred, it was because of the plaintiff's own negligence.

In court documents obtained by E! News, Brand claims any injury sustained was the ""direct, proximate and sole result"" of Sneed's own ""physical bodily condition and constitutional composition"".

Sneed's complaint cited wage loss, medical expenses and loss of earning capacity, but Brand claims his accuser was employed and therefore entitled to worker's compensation at the time of the alleged incident.

His filing also states that Sneed ""failed to take adequate measures to minimise... delays, damages, expenditures and extra costs, if any were incurred"".
