KALAMAZOO (WKZO) -- Court documents suggest that the only reason there were not more victims when a gunman opened fire on a crowd in a parking lot at Stadium Drive Apartments early Sunday, was because he ran out of bullets.

An officer testified that Tyrein Sheppard shot and wounded 18-year-old Richard Smith, shot at a car, and then fatally shot Jante Mackerel in the head. He was aiming at a third person and pulling the trigger when the gun ran out of bullets.

Sheppard is being held without bond on multiple charges including open murder, attempted murder and felony gun counts.

A judge will determine on November 6th if there is enough evidence to bind him over for trial. The Funeral for Sunday Morning’s other murder victim, 23-year-old Luke Vincent has been set for this morning at 11 at Otsego United Methodist church. Police say he died in a drunken argument with his roommate.
