Michigan residents cannot sue over meningitis cases

LANSING (WKZO) -- More cases of fungal meningitis linked to contaminated steroid injections are being reported each day.  While Michigan is the only state in country where victims of faulty drugs cannot sue drug manufacturers, legal experts say there may be a loophole for those victims and their families.

According to Michigan law, drug companies can only be sued if it's proven that they committed fraud in an attempt to get FDA approval for the product.  At issue in this case is the fact that the compounding companies, like the one in New England that made the steroid, do not need approval from the FDA and, therefore, are not granted the same immunity as other drug makers.

The compounding center has recalled all of its products in the wake of the meningitis outbreak that has killed 12 people and sickened over 130.
