In a request for a restraining order against Berry's French fiance Olivier Martinez, following the pair's Thanksgiving Day (22Nov12) fight, former model Gabriel Aubry's legal representative referred to his client's ex as his former bride multiple times.

But now the Canadian hunk's reps have revealed the mention is ""simply an error"" - and Aubry and Berry were never married.

Aubry's restraining order request was granted. There is also a temporary restraining order on him - preventing the ex-model from getting close to Berry or their four-year-old daughter Nahla.
