COLDWATER, MI (WTVB) - Tom Foley is a free man. After serving 20 months in prison following his first degree murder conviction in the death of his wife Dee Dee in March of 2009, a Branch County Circuit Court jury Saturday afternoon ended Foley’s retrial by finding him not guilty.
The jury deliberated a total of ten hours on Friday and Saturday before returning the verdict in the second trial which began almost three weeks ago. Following his release from the Branch County jail, Tom Foley’s emotions continued to overflow saying he was so glad to be home, that it was a long, long road.
And when I asked Foley if there was any one message he wanted to make public following his acquittal, he said they need to find his wife’s killer, that’s has to be number one from here on out.
The re-trial was ordered by the presiding Judge in the first trial, and this trial as well, Calhoun County Circuit Judge Conrad Sindt, after three witnesses came forward with new evidence following Foley’s conviction.
Foley’s attorney, Thomas Schaeffer, was grateful for the verdict and the system “thanks for the system, thanks for this country, a system that will undo a wrong, even though it takes a long time to do it, it happened”
