LANSING (WKZO) -- The Michigan Court of Appeals makes another major decision regarding medical marijuana by requiring users to have their state-issued ID cards in hand before they can legally grow their own drugs.
In a ruling in a Montmorency County case, appellate judges upheld a Circuit Court decision that Brian Reed could be tried for manufacture of marijuana even though he has a user's card. In August 2009 a narcotics team found six plants growing on Reed's property, almost a month before he got a doctor's certification and a user's card.
The court ruled that without the card at the time of the alleged crime, there is no immunity from arrest, prosecution, or penalty. Last week the appellate court outlawed retail sales at medical marijuana dispensaries.
