Trial date set in former employee's lawsuit against city

WAUSAU, Wis. (WSAU) – Wausau’s former engineer will try to prove during a jury trial scheduled for next spring that the city violated a settlement agreement when it laid him off last year.

A scheduling order signed by a judge Wednesday sets a four-day jury trial in Dale “Tony” Lehman’s civil lawsuit against the city for May 2, 2011. Lehman’s attorney specifically asked for a jury of 12 peers to hear the case.

Lehman claims the city violated the terms of a 2004 settlement agreement when it laid him off November 30th. City officials claim that Lehman and three other employees were permanently laid off for budget reasons.

In an answer filed in late May, the city said Lehman failed to state a claim upon which relief can be granted. The city also said if Lehman suffered any injuries, “all of such injuries and damage were caused through his own conduct, negligence and behavior…and through no fault or conduct on city’s part.”
